These Terms of Service (Terms), which govern your use of the websites, applications, and other services provided by DukaERP (collectively, the DukaERP Platform), are a legally binding agreement between you and DukaERP. DukaERP, we, us, or our, refer to the DukaERP entity listed on Schedule 1 with whom you are entering into a contract when used in these Terms. The DukaERP Platform provides users (referred to as Members) with a platform online where they may publish, offer, search for, and book and list property and services. Hosts are members who post and offer services, whereas Guests are members who look for, reserve, or use services. Accommodations, experiences, and other travel-related services are all provided by hosts (collectively referred to as Host Services, with each listing for a Host Service being referred to as a Listing). You must sign up. For access to and use of many services of the DukaERP Platform, you must create an account, and you must maintain the accuracy of your account information. DukaERP does not own, provide, or manage any Listings or Host Services in its capacity as the platform's provider. In addition to not being a party to the agreements made directly between Hosts and Guests, DukaERP is also not a real estate broker, travel organization, or insurance company. Except as provided in the Payments Terms of Service (the Payment Terms), DukaERP is not representing any Member in any way. Our Privacy Policy, which outlines how we gather and utilize personal data, is one of the many terms and policies we keep.any payment services provided to Members by the DukaERP payment entities are governed by our Payments Terms. If you are a Host, it is your duty to comprehend all legal requirements that apply to your host services as well as to any agreements you may have with third parties.
Our goal is to provide a world where everybody can feel at home. Browse through millions of Listings to identify the accommodations that best suit your style of travel, from cabins to castles to cooking classes. Examine the listing's summary and images, and any guest reviews to find out more information. Simply message the host if you have any questions.
Searching: Using search parameters such the type of host service, trip destination, departure dates, and number of guests, you can find hosts. Additionally, filters can be used to narrow down the search results. The relevancy of the search results to your query and other factors are taken into consideration. Relevance takes into account a number of variables, including price, availability, reviews, cancellation history, popularity, saved listings, prior visits, host needs (such as minimum or maximum stays), and more. Reservations: A reservation for an accommodation grants you a specific license to access, occupy, and utilize the accommodation. During your stay, the Host has the right to re-enter the Accommodation, provided that doing so is I reasonable, (ii) allowed under your agreement with the Host, and (iii) legal. If you linger after check-out, the Host has the right to make you depart in a way that complies with the law, including by charging fair overstay fines. The maximum number of permitted Guests may not be exceeded by You.
If you cancel a reservation as a guest, the cancellation policy that governs that reservation will decide how much will be reimbursed to you. Assuming the property you rented accepts cancellations once rent has been paid
Your Responsibility. You are accountable and liable for your own actions as well as those of whom you ask to participate in or grant access to any accommodation, experience, or other host service. This includes, for instance, the following: I you are responsible for returning an Accommodation (and related personal property) in the same condition that you found it; (ii) you are accountable for paying all reasonable Damage Claim amounts required to cover damage that you, your guests, or your pets cause to an Accommodation; and (iii) you are required to always act honorably, respect others, and abide by the law. You must have legal authority to act on behalf of the minor if you are making a reservation for them or if you bring them to a host service. You are also completely responsible for their supervision.
You're Taking a Risk. You agree to accept all risks associated with your use of the DukaERP Platform, any Content (as defined in Section 10), your participation in any Experiences, your use of any other Host Services, and any other interactions you have with other Members, whether in person or online, to the fullest extent permitted by applicable law. You also acknowledge that many activities carry inherent risks. This implies that it is your duty to research a Host Service to see if it is appropriate for you. For instance, by electing to engage in Host Services, you voluntarily and knowingly bear all risk of illness, bodily harm, disability, or death.
Host. As a host, DukaERP gives you the opportunity to share your property, or other host service with our diverse community of guests while also earning money. You may control how you host by setting the pricing, availability, and rules for each Listing. It's simple to create a Listing.
Hosts' independence. Except as provided in the Payments Terms, your relationship with DukaERP is that of an independent person or business; you are not DukaERP's employee, agent, joint venture partner, or joint venturer. You agree that you have entire discretion over whether and when to offer Host Services, as well as what to charge and under what conditions. DukaERP does not guide or manage your Host Service.
Dealing with Guests. It is your responsibility to provide your Host Service in accordance with the conditions and at the price listed in your Listing when you accept a booking request or get a booking confirmation made through the DukaERP Platform. Additionally, you consent to paying all applicable costs, including each booking's service fee from DukaERP (as well as any applicable taxes). In the absence of an alternative arrangement between us and you, DukaERP Payments will deduct any amounts you owe from your compensation. In addition to these Terms, our Additional Legal Terms, Policies, and the details in your Listing, any terms, policies, or conditions that you include in supplemental contracts with guests must (i) be in accordance with those in those documents and (ii) be clearly disclosed in your Listing.
Understand Your Legal Duties. Any laws, rules, regulations, and agreements with third parties that are relevant to your Listing or Host Services must be understood and complied with by you. For instance: Subletting, short-term rentals, and/or longer-term stays are sometimes restricted or forbidden by landlords and leases, as well as by homeowner and unit association laws. The short-term leasing of residential premises is prohibited by zoning regulations or other restrictions in some cities. Before offering specific Host Services, several jurisdictions demand that Hosts register, receive a permit, or obtain a license (such as short-term rentals, longer-term stays, preparing food, serving alcohol for sale, guiding tours, or operating a vehicle). The Host Services you plan to provide can be totally illegal in some locations. Some jurisdictions call for you to register visitors who stay at your lodging. Laws in some areas grant Guests tenancy rights and impose additional duties on Hosts. For instance, eviction, rent control, and landlord-tenant rules may be applicable in some locations to extended stays. To find out which regulations apply to the host services you intend to provide, consult your local laws. You should independently confirm your obligations . In accordance with these Terms, including our Host Privacy Standards, and any applicable privacy laws, you are in charge of handling and using the personal information of guests and other individuals. Always seek legal counsel if you have doubts about how local laws apply.
Your Obligations. You are accountable and liable for your own actions and omissions as well as those of anybody you permit to assist in rendering your host services. You are in charge of deciding on your listing's pricing as well as its terms and conditions. Any fees and charges must be specified in your listing description, and you are not permitted to collect any additional fees outside of the listed fees on DukaERP platform. Do not encourage guests to transgress our Off-Platform Policy by opening accounts on unapproved third parties, posting reviews or divulging contact details.
Hosting as a Group or Company. If you collaborate with a co-host or host as a group, company, or other organization, that group or any person involved in offering Host Services is held accountable and liable as a Host under these Terms. If you agree to terms or enter into a contract, you represent and warrant that you are able to bind your team, business, or other organization to those terms and that each entity you use is legitimate under the laws of the jurisdiction in which it is based. If you carry out any additional duties, you guarantee that you have the necessary authority. You must have the right to do so and are accountable and liable for the payment amounts and accuracy of any payout information you give
Booking amendments. Both hosts and guests agree to pay any additional sums, fees, or taxes related to a booking modification and are accountable for any changes
cancellations; the cancellation policy that applies to that Reservation governs the amount paid to you in the event that a Guest cancels a Reservation (assuming they have stated they allow cancellation of booking). You should not cancel on a guest as a host unless you have a good reason to do so in accordance with the law of country.
Host Taxes. Any applicable VAT or other indirect taxes, occupancy taxes, tourism, income, or other taxes must be reported, collected, remitted, or included in your pricing. It is your responsibility as the host to ascertain these duties and to carry them out (Taxes).
Reviews. Both guests and hosts will have the chance to rate an write reviews for one another following each host service. Your Review must be truthful and may not use any language that violates our Content Policy or Review Policy, including content that is discriminatory, offensive, defamatory, or similar. Reviews are not accuracy-verified by DukaERP and may be false or deceptive.
You can submit comments, text, photographs, audio, video, information, and other content (collectively, Content) through certain portions of the DukaERP Platform. You grant DukaERP a non-exclusive, worldwide, royalty-free, perpetual, sublicensable, and transferable license to copy, modify, create derivative works of, distribute, publish, and otherwise exploit the Content you provide, in whatever form and by whatever methods. If any Content contains personal data, our Privacy Policy explains how we utilize that data. When DukaERP facilitates or pays for the creation of Content, DukaERP may own the Content; in that instance, extra agreements or disclosures will make that clear. All content you submit is your responsibility alone, and you guarantee that you either own it or have the right to give DukaERP the license to use it.
All Content you provide is exclusively your responsibility, and you guarantee that you either own it or have the right to grant DukaERP the licenses set out in these Terms. If any of your Content violates or infringes upon a third party's intellectual property or privacy rights, you are accountable and liable. Content must adhere to our Nondiscrimination Policy and Content Policy, which among other things forbid discriminatory, vulgar, harassing, false, violent, and unlawful content. You agree that DukaERP may make automated translation tools or services available, and that your content may be translated using these tools or services. Members are responsible for verifying the accuracy of such translations because DukaERP does not guarantee their quality or accuracy.
DukaERP does not charge any fees for listing your property of for renting out. We are a free entity and we rely on donations and promotions to meet the companys expenses.
You must abide by these regulations and you must not encourage, assist, or help others break or get around them.
Violation Reporting. Before contacting DukaERP, you should immediately get in touch with your local authorities if you think that a Member, Listing, or other piece of content poses an immediate threat to the safety of someone or anything. Additionally, you should contact DukaERP if you think a Member, Listing, or Piece of Content has broken our Standards. If you complained about a problem to the authorities in your area, DukaERP might want a copy of that complaint. You acknowledge that we are under no obligation to respond to any report, unless otherwise compelled by law.
Notices of Copyright. Please let us know if you believe that any content on the DukaERP Platform violates any copyrights.
Term. When you access the DukaERP Platform (for example, to create an account), the agreement between you and DukaERP expressed by these Terms comes into force. It stays in effect until either you or we terminate the agreement in accordance with these Terms.
Termination. By emailing us or deleting your account, you can discontinue this agreement at any time. Anytime, for any reason, DukaERP may terminate this Agreement and your Account by sending you a 30-day email notice or by using any other contact details you have supplied for your Account. If you violate any of the Terms or Policies, these Terms, any applicable laws, or if DukaERP reasonably believes that termination is necessary to protect DukaERP, its Members, or third parties, DukaERP may also immediately and without notice terminate this agreement and stop granting access to the DukaERP Platform. We reserve the right to close your account immediately if it has been dormant for more than two years.
Legal requirements In order to comply with the law, or the order or request of a court, law enforcement, or other administrative agency or governmental body, DukaERP may take whatever action it deems reasonably required.
These Terms may be changed at any moment by DukaERP. When we make significant changes to these Terms, we'll update the Last Updated date at the top of these Terms and post the new Terms on the DukaERP Platform. Any significant changes will also be communicated to you through email at least 30 days before they take effect. You may immediately terminate this agreement in accordance with these Terms if you object to the updated Terms. Your continued access to or use of the DukaERP Platform will indicate acceptance of the updated Terms if you don't cancel your agreement before the date the revised Terms take effect.
If a Member presents convincing evidence that you, your visitor(s), or your pet(s) caused damage to the complaining Member's real or personal property, or real or personal property for which the complaining Member is accountable, including resulting losses (Damage Claim), the complaining Member may notify DukaERP and/or pursue redress through the Resolution Center. You'll be informed of the damage claim and given the chance to comment. . You acknowledge that DukaERP may make a claim against you under any insurance.
We grant you the privilege of using a system that lets Members post, offer, look for, and reserve host services. While we make every effort to guarantee that our Members have wonderful DukaERP experiences, we are unable to control how guests and hosts behave. You agree that DukaERP has the right, but not the duty, to keep an eye on how the DukaERP Platform is being used and to check the accuracy of the information provided by our Members. In order to: I operate, secure, and improve the DukaERP Platform (including for fraud prevention, risk assessment, investigation, and customer support purposes); (ii) ensure Members comply with these Terms; and (iii) comply with applicable law or the order or requirement of a court, for instance, we may review, disable access to, remove, or edit Content. Vi) uphold and enforce any quality or eligibility requirements, including by removing Listings that don't meet those standards. (iii) Comply with applicable law or the order or requirement of a court, law enforcement, other administrative agency, or governmental body. (iv) Address Content that we determine to be harmful or objectionable. Members accept and concur that DukaERP, in its exclusive discretion, is responsible for the administration of the Additional Legal Terms, Policies (such as our Extenuating Circumstances Policy), and Standards (such as the fundamental standards for hosts). Members agree to work cooperatively and in good faith with DukaERP, to supply DukaERP with the information it reasonably requests, and to take any other actions that DukaERP reasonably requests in connection with any investigation it conducts into possible misuse or abuse of the DukaERP Platform. Except in cases when DukaERP Payments works as a collection agency in accordance with the Payments Terms, DukaERP is not acting as an agent for any Member.
To access and use many features of the DukaERP Platform, you must first register an account. Only natural persons, partnerships, and legal entities that are 18 years of age or older are eligible to register. You guarantee and declare that neither you nor any other person or entity are prohibited from using the DukaERP Platform by the laws of the country in which you now reside, or any other relevant jurisdiction. During registration, you must submit true, current, and comprehensive information; you must also maintain your account information current. You are not permitted to open additional accounts or transfer your account to another person. You are in charge of protecting the privacy and security of your account credentials, and you are not allowed to give them to anyone else. To access and use many features of the DukaERP Platform, you must first register an account. Only natural persons, partnerships, and legal entities that are 18 years of age or older are eligible to register. You guarantee and declare that neither you nor any other person or entity are prohibited from using the DukaERP Platform by the laws of the country in which you now reside, or any other relevant jurisdiction. During registration, you must submit true, current, and comprehensive information; you must also maintain your account information current. You are not permitted to open additional accounts or transfer your account to another person. You are in charge of protecting the privacy and security of your account credentials, and you are not allowed to give them to anyone else. You are in charge and answerable.
We make the DukaERP Platform and all Content available `as is` and without any express or implied warranties of any kind. For instance, I we do not guarantee the existence, conduct, performance, safety, quality, legality or suitability of any Guest, Host, Host Service, Listing, or third party; (ii) we do not guarantee the performance or non-interruption of the DukaERP Platform; and (iii) we do not guarantee that verification, identity, or background checks conducted on Listings or Members (if any) will identify previous wrongdoing or stop future wrongdoing. Any references to a Member or Listing being verified (or similar language) exclusively pertain to the completion of the necessary identification or verification procedures by the Member, Listing, or DukaERP.
Neither DukaERP (including its affiliates and employees) nor any other party involved in developing, producing, or delivering the DukaERP Platform or any Content will be liable for any incidental, special, exemplary, or consequential damages, including lost profits, lost data, lost goodwill, service interruption, computer damage, system failure, or the cost of substitute goods or services, as well as for any damages for personal injury, physical harm, or emotional distress that may result (iv) the publication or use of a Listing, including the provision or use of Host Services, whether based on a warranty, contract, tort (including negligence), product liability, or any other legal theory, and whether or not DukaERP has been made aware of the possibility of such damage, even in the event that a limited remedy set forth in these Terms is found to have failed of its essential purpose.
To the fullest extent permitted by law, you agree to hold harmless DukaERP (including DukaERP Payments, other affiliates, and their employees) from and against any claims, liabilities, damages, losses, and expenses, including, without limitation, reasonable legal and accounting fees, arising out of or in any way related to: I your violation of these Terms (including any supplemental or additional terms that may be provided by DukaERP); and (ii) your use of the Services in violation of any applicable laws. Additional Legal Terms, Policies, or Standards, (ii) Your Inappropriate Use of the DukaERP Platform, (iii) Your interaction with any Member, stay at an Accommodation, participation in an Experience, or use of any other Host Service, including without limitation any harm, loss, or damage (whether compensatory, direct, incidental, consequential, or otherwise) of any kind resulting from or connected with such interaction, stay, participation, or use, , (iv) Your failure, at your direction, to accurately report, collect, or remit Taxes, or (v) your violation of any of the terms
Any right or term in these Terms that DukaERP fails to enforce will not be deemed to have been waived until acknowledged and agreed to in writing by DukaERP. Except as specifically provided in these Terms, the exercise of any remedy by either party hereto shall be without prejudice to such party's other remedies hereunder or otherwise available at law.
Without DukaERP's prior written authorization, you are not permitted to assign, transfer, or delegate this agreement or your rights and duties herein. With a 30 day notice period, DukaERP may freely assign, transfer, or delegate this agreement and any rights and obligations thereunder.
Service Providers. Links to third-party websites, applications, services, or resources (collectively, Third-Party Services) may be found on the DukaERP Platform. These Third-Party Services may have their own terms and privacy policies. Links to such Third-Party Services do not constitute an endorsement by DukaERP and are provided for convenience only.
Platform Content for DukaERP. The DukaERP Platform may make available content that is covered by copyright, trademark, and/or other laws from the different nations. You agree not to delete, modify, or obscure any copyright, trademark, service mark, or other proprietary rights notices and acknowledge that DukaERP and/or its licensors are the sole owners of all intellectual property rights for the Content. Except to the extent that you are the legal owner of the Content or as expressly permitted by these Terms, you may not use, copy, adapt, modify, create derivative works from, distribute, license, sell, transfer, publicly display, publicly perform, transmit, broadcast, or otherwise exploit any Content accessed through the DukaERP Platform.You are given a limited, non-exclusive, non-sublicensable, revocable, and non-transferable license by DukaERP, subject to your compliance with these Terms, to I download and use the Application on your personal device(s); and (ii) access and view the Content made available on or through the DukaERP Platform and accessible to you, solely for your own personal and non-commercial use.
